HIS MAJESTY THE SULTAN ISSUES FIVE ROYAL DECREES

MUSCAT: Royal Decree 40/2015 promulgates Law on Regulating the Obligations of Personnel of all State Establishments and Members of Appointed and Elected Councils.

Article 1 states that the provisions of this law shall apply to every person who is working or was working for any state establishment or private establishments or associations/societies dealing with public interest or any other party wherein the state or any state establishment contributes to the capital or financial resources in any form.

The provisions of this law also apply to any person who is a member or was a member in appointed or elected councils or the boards of directors of establishments, associations/societies or the parties cited in the above-mentioned clause.

Article 2 says that, without prejudice to the obligations imposed by any laws and Royal Decrees, the persons addressed by the provisions of this law are prohibited from the following:

Broadcasting or publishing any news or rumours targeting the state’s authorities or aimed to weaken confidence in them or incite to that or facilitate that for others by any means.

2. Obstructing the implementation of projects that are carried out by the state or its establishments or inciting to that or facilitating that for others.

3.Divulging any secret information or data or documents to which the employee has access by virtue of his position or job/work or membership, or using those documents or data by any means to achieve personal benefit for him or others or inciting or facilitating that.

4. Insulting any official or public employee by words or deeds or hinting or allusion or aggressing a public official or public employee while that person is performing the duties or tasks of his job, or when he is acting in his official capacity at any venue.

Article 3 instructs all the persons addressed by the provisions of this law to adhere to the provisions of enforced laws and Royal Decrees and treaties and international agreements that are considered as part of the country’s law or any other bylaws, regulations and decisions enforcing the same. Those persons are also prohibited from breaching or violating the above-mentioned laws, regulations and decisions.

Article 4 stipulates that anyone who violates or breaches the provisions of this law shall receive maximum penalties stated for such violations in the current laws and regulations.

Article 5 says that this law shall be published in the Official Gazette and enforced on the day following its date of publishing.

The Decree has been issued on October 27, 2015.

Royal Decree 41/2015 restructuring public authorities and establishments.

Article 1 states that public authorities and establishments shall propose the policies that they undertake when practising their specialisations and that they shall submit these proposals to the Council of Ministers for approval.

Article 2 states that the Council of Ministers shall conduct an assessment of the policies applied in public authorities and establishments and that the Council of Ministers is empowered to amend those policies in accordance with the general policy of the state.

Article 3 bans combining the post of chairman of board of directors and chairman or chief executive officer in public authorities and establishments. It stipulates that the Council of Ministers shall undertake the adjustment of conditions of existing public authorities and establishments in accordance with the provisions of this article.

Article 4 instructs public authorities and establishments to carry out the provisions of this Decree.

Article 5 says that this Decree shall be published in the Official Gazette and enforced on its date of issue.

The Decree has been issued on October 27, 2015.

Royal Decree 42/2015 issues amendments to some provisions of the Law on Classification of State Records and Organisation of Protected Areas.

Article 1 states that the amendments attached to this Decree shall be applied to the Law on Classification of State Records and Organisation of Protected Areas issued under Royal Decree 118/2011.

Article 2 cancels all that contradicts the attached amendments or contravenes their provisions.

Article 3 says that this Decree shall be published in the Official Gazette and enforced on the day following its date of publishing.

The Decree has been issued on October 27, 2015.

Royal Decree 43/2015 issues amendments to some provisions of The Research Council Law.

Article 1 states that the amendments attached to this Decree shall be applied to The Research Council Law promulgated by Royal Decree 54/2005.

Article 2 cancels all that contradicts the attached amendments or contravenes their provisions.

Article 3 says that this Decree shall be published in the Official Gazette and enforced on the day following its date of publishing.

The Decree has been issued on October 27, 2015.

Royal Decree 44/2015 ratifies the Revised Charter of the Organization of Islamic Cooperation

Article 1 ratifies the Revised Charter of the Organization of Islamic Cooperation dated September 26, 2008 as per the version attached to this Decree.

Article 2 states that this decree shall be published in the Official Gazette and enforced on its date of issue.

The Decree has been issued on October 27, 2015.
